The defendants in error moved to dismiss the writ of error, on the ground that at the time of its certification by the judge whose judgment is excepted to, there was pending in the trial court a motion for a new trial. The bill of exceptions is a direct bill wherein the direction of a verdict for the plaintiff is directly excepted to by the defendants.
