OPINION
LOPEZ, Justice.
This is a delayed indictment case. For the reasons stated in the opinion, we reverse and remand with instructions to grant habeas corpus relief.

On October 4, 1996, Melanie Cathcart was involved in an automobile accident. She was arrested for the offense of driving while intoxicated (“DWI”) and intoxication assault and released on $800.00 bail on October 5, 1996.
