STEELE, Chief Justice:

Defendant-appellant Edwin Scarborough appeals from a Superior Court judge’s denial of his request to withdraw his guilty plea. After Scarborough pleaded guilty to three felonies, he later attempted to withdraw his guilty plea at the sentencing hearing. Scarborough argued that the Superior Court judge should permit him to withdraw his guilty plea because, at the time he signed the plea, he did not believe that the State would move to declare him an habitual offender under 11 Del. C. § 4214(a) because of an oral side agreement that he had made with the prosecutor not set…
