Plaintiff’s intestate was on May 24,1896, fatally injured while he was riding on top of a cattle car in Cincinnati, Ohio, by striking a bridge under which he was passing. From the effects of his injuries he died the nest day. March 29, 1898, plaintiff began an action against defendant, similar to the one at bar, in the Superior Court of Cook county, seeking damages for the death of her intestate, which she averred resulted from actionable negligence of defendant.
