• Error to the Court of Common Pleas of Luzerne county: Of January Term 1878, No. 242. Case by Gilbert Jones against the Luzerne Coal and Iron Company, to recover damages for the death of his son, which, it was alleged, was caused by the negligence of .defendants. Plea, “Not guilty.” It appeared that on the 12th of February 1876, an explosion took place in a mine of the defendants, known as the Exeter Shaft, Avherein four men were killed, among whom was the plaintiff’s son.

This suit was brought by defendant in error to recover damages for the death of his son, Alexander Jones. He was killed by an explosion of gas, in the colliery of the plaintiff in error, known as the “Exeter Shaft,” and while in the employ of the company. It is claimed that the explosion was caused by an insufficient supply of fresh air.
