This suit involves the doctrine- of stare, decisis. It is essentially appellants’ conten-, • tion that the case of Town of Refugio v. Heard was not fully developed on the facts, and 'therefore the decision of the Supreme Court in such litigation is not binding in the present suit. In the case mentioned, the Town of Refugio brought suit against certain owners of uplands abutting upon- the Mission River, claiming ownership of lands within the river bed.
