Main, J. Proceeding pursuant to CPLR article 78 (initiated in this court pursuant to CPLR 506 [b] [1]) to review a determination of respondent which denied petitioner’s application for a pistol permit.

In January 1983, petitioner’s pistol permit was revoked based upon his conviction, after a guilty plea, of the crime of assault in the third degree. As a result of the assault conviction, which stemmed from an altercation between petitioner and his then-wife, petitioner was sentenced to a one-year conditional discharge.
