JOHNSON, District Judge.
The plaintiffs, as Negro residents or citizens of Butler County, Alabama, and the members of the class they represent, filed with this Court on August 27, 1965, their complaint, motion for a temporary restraining order, and motion for a preliminary injunction. This Court by formal order on August 31, 1965, denied plaintiffs’ request for a temporary restraining order, which was sought without notice to the defendants and without this Court’s hearing any testimony in support thereof.
