The defendant in this case was convicted hy the court of sessions in Orleans- county, of violating the 22d section of the excise law, which forbids the sale of intoxicating liquor on Sunday by licensed innkeepers. (2 R. S. 5th ed. 944.) And the conviction has been brought into this court by certiorari. The indictment contains three counts, charging the violation of this section of the statute on different days of different months, but each offense is stated substantially in the same language.
