— This is an action brought by the appellees against the appellant to quiet the title to certain real estate. The question presented arises on the overruling of a demurrer by the appellant to the complaint. As appears by the averments of the complaint one Thomas J. H. Bower was the owner of the real estate in controversy, situate in Jackson county. On the 25th day of April, 1876, one Josiah Cobbs recovered a judgment in the Jackson Circuit Court for the sum of $92 and costs against said Thomas J. H. Bower and Simeon Stockdell.
