The question on this appeal is whether equity has jurisdiction of the subject matter of the complaint. Although' that,' and that alone, is the sole question of law here involved, it will require a factual recital of some length for a correct understanding of the legal problem from which the court below appears to have been diverted by extraneous and immaterial considerations.
