OPINION

Following a jury trial in the circuit court of Cook County, defendant, Efren Melchor, was convicted of first degree murder. See Ill. Rev. Stat. 1989, ch. 38, par. 9 — 1(a). At the close of a sentencing hearing, the trial court sentenced defendant to a prison term of 40 years. Finding that the admission of certain evidence violated defendant’s constitutional rights, the appellate court reversed defendant’s conviction and remanded…
