Frederick Nye was charged with the crime of murder of the first degree, and in the Court of Oyer and Terminer of Northumberland County he was convicted thereof, and sentenced accordingly. He has appealed, and in the first assignment of error his counsel contend that the court below erred in overruling defendant’s motion to quash the array of jurors, for the reason that they had not been summoned in accordance with Section 125 of the Act of April 14, 1834, P.
