This suit was brought by the appellee, A. C. Grimes, against the appellant, the Erie Telegraph and Telephone Company, in Karnes County (the venue changed to La Salle), to recover damages (actual $5000 and exemplary $5000) for failure to send a telegram from Kenedy to Bastrop, whereby plaintiff failed to see his mother in her last sickness and to attend her funeral. There is no question as to exemplary damages in the case.
