In November of 1977, claimants were students at the State University of New York at Binghamton (University), an educational institution owned, operated and funded by the State of New York.1 Approximately one week prior to November 11, 1977, someone emptied the contents of a carbon dioxide fire extinguisher on the walls of one of the *1093floors in Oneida Hall, a student residential dormitory at the University.
