Appeal from an order of the County Court of Broome County (Cawley, J.), entered September 9, 2009, which classified defendant as a risk level three sex offender and a sexually violent offender pursuant to the Sex Offender Registration Act.
In 1999, defendant pleaded guilty to rape in the first degree and attempted sodomy in the first degree in full satisfaction of two indictments, and he was sentenced to a term of imprisonment of 8 to 16 years. In anticipation of his release from prison, the Board of Examiners of Sex Offenders classified defendant as a presumptive risk level three sex offender…
