Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

Petitioner, a prison inmate, was charged in a misbehavior *743report with violating prison disciplinary rules which prohibit possession of contraband, possession of a controlled substance and smuggling. During a tier III hearing, petitioner made certain admissions which the Hearing Officer construed as a plea of guilty of possession of a controlled substance.…
