MEMORANDUM OPINION

ECONOMUS, District Judge.

This matter is before the court on the request of Plaintiff, Robert W. Earley (“Ear-ley”) for a permanent injunction. Earley has alleged violations of the Federal Wiretap Act (“Act”), 18 U.S.C. § 2510 et. seq., as well as related state law claims. Earley seeks to prevent Defendants from commencing a trial of an intra-union charge against him for breach of duty based upon a tape recording which was made without his knowledge or permission. A hearing regarding the permanent injunction was held on May 31, 1996.
