After a thorough study and careful consideration of the entire record in this case,I am unable to '-concur in the foregoing opinion of my associates.

It is my profound judgment and conclusion that the judgment of conviction in this case is wrong and unjust, under the facts and conditions disclosed by the record. The unusual and unprecedented manner in which the trial below was had, leads me to the conclusion that there exists a very grave and substantial doubt as to the guilt of the defendant, and because of which, error prevailed in the action of the trial court in overruling and denying…
