BOX, Judge:

An appeal by Katheryn Carlyle, plaintiff in the trial court, from a judgment in favor of appellee, Equity Benefit Life Insurance Company, in an action to recover accidental death benefits.

The beneficiary under an accident insurance policy brought suit to recover the benefits payable for accidental death. The insurer defended on the ground that the insured’s death was not accidental within the terms of the policy because it was the result of bullet wounds inflicted upon him while he was engaged in the commission of an armed robbery.
