In an action, inter alia, to impose a constructive trust on the proceeds of the sale of certain real property, the plaintiff appeals from an order of the Supreme Court, Queens County (Dollard, J.), dated July 7, 2003, which granted the defendant’s motion, denominated as one for leave to reargue, but deemed one for leave to renew, the defendant’s prior motion to vacate his defaults in timely answering the complaint and in opposing the plaintiffs motion for a default judgment which was denied in an order of the same court dated April 21, 2003, and upon renewal, granted the motion to vacate.
