It appears from the record that on April 17,1900, James L. Baker was indicted by the grand jury of Fulton county for the murder of Ms wife, alleged to have occurred on the 13th of that month, and that on April 19,1900, he was tried, convicted, and sentenced to be hanged for the crime. No plea of Msanity was filed on the trial. A new trial was moved for in Baker’s behalf, and one of the grounds of the motion was that Baker was Msane at the time he did the killing.
