This appeal involves the rights of rival claimants to five memberships on the board of education of the city of Hopkinsville, and the decision depends upon a determination of the authority to fill vacancies in the hoard when less than a quorum remains in office.

The five appellants claim the offices by virtue of appointment by the Governor, and insist that, under the circumstances that existed in this case, the power to fill vacancies is reposed by law in the chief executive of the state. Five of the individual appellees assert title to the same…
