This case came on upon Defendant’s Motion For Summary Judgment, filed herein on April 27, 1987. Plaintiff’s response in opposition was filed on June 10, 1987. The Court heard oral argument on June 23, 1987.
In Count I, plaintiff, E.T. Manufacturing, Inc. [hereinafter “E.T.”] brings an action for patent infringement. In Count II, E.T. brings an alternative cause of action for misappropriation and unlawful use of its proprietary and confidential information. Defendant Xomed, Inc.
