In an action for, inter alia, a judgment declaring the rights of the parties with respect to certain real property, the plaintiff appeals from an order and judgment (one paper) of the Supreme Court, Suffolk County (Gowan, J.), entered June 14, 1993, which, upon denying his motion for *492summary judgment and granting the defendant’s cross motion for summary judgment, is in favor of the defendant and against him.

Ordered that the order and judgment is reversed on the law, with costs, the plaintiffs motion for summary judgment is granted, the defendant’s cross motion for summary judgment is denied,…
