Radke Ex Rel. Radke v. Radke

Appellate Court of Illinois

Decided May 14, 2004No. 3-03-0198PublishedCited by 4 opinions

1Opinion of the CourtJustice Slater

The trial court granted the petitioner, Kathryn Radke, a plenary order of protection restraining the respondent, Ross Radke, from abusing, harassing, intimidating or interfering with the personal liberty of the parties’ daughter. Ross appeals, contending that: (1) the trial court abused its discretion in granting the order of protection because the evidence did not support a finding of harassment; and (2) any action to restrict his contact should have been taken under the existing dissolution action rather than by obtaining an order of protection. We reverse.
