The motion to make the petition more-definite and certain, the demurrer to the petition, and the objection to the introduction of evidence under the-petition, were all properly overruled,. and the objections to evidence were all properly dealt with, since notwithstanding, the failure of the plaintiff to list all his. property he could recover taxes which were wrongfully charged against him under color of section 7599 of the-General Statutes of 1901 and which' he paid under the compulsion of a tax warrant.
