Stanley Pipal (hereafter referred to as plaintiff) brought an action under the Federal Employers’ Liability act in the superior court of Cook county against the Grand Trunk Western Railway Company (hereafter referred to as defendant) for personal injuries received by him as its employee while serving under the direction of defendant’s foreman or vice-principal in unloading and removing steel railroad rails from a freight car.
