Plaintiff Pekin Insurance Co. (Pekin) filed this declaratory judgment action and appeals the trial court’s denial of its motion for summary judgment and granting of Roszak/ADC, LLC’s (Roszak) cross-motion for summary judgment, finding that Pekin owes Roszak a duty to defend. 735 ILCS 5/2 — 1005 (West 2008). In the underlying action, Deirdre Hastings had filed suit against Roszak, among others, alleging negligence and premises liability theories for personal injuries that she sustained while working on a construction site when Roszak…
