Lugo v. Evans

Petitioner is serving a prison sentence of 15 years to life, imposed in January 1982 upon his conviction of murder in the second degree. In January 2010, he made his eighth appearance *1357before the Board of Parole seeking release to parole supervision. Petitioner’s request was denied, and he was ordered held for an additional 24 months. He then commenced this CPLR article 78 proceeding seeking to challenge the Board’s determination. Supreme Court dismissed the petition, and petitioner now appeals.
