Plaintiff has appealed to the Superior Court from orders of this court which sustained defendants’ demurrers to the complaint and dismissed the' complaint with prejudice. After plaintiff filed his complaint, defendants filed preliminary objections in the nature of a demurrer. Plaintiff then requested a judge from outside Philadelphia County to be assigned to the case, and by order of the Honorable Robert N.C. Nix Jr., Chief Justice of Pennsylvania, the undersigned was designated to preside specially over the matter. Oral argument was held before a court en banc…
