William Grayson Mann was the life-tenant and the defendants are the remaindermen of a certain trust estate created by the will of George B. Cumming. A part of the property of this trust estate consisted of shares of stock in the Southwestern Railroad Co., and shares of stock in the Savannah-Gas Light Co. Mann, the life-tenant, died on Nov. 20, 1896, and each of these corporations declared a semi-annual dividend on Jan. 1, 1897, from its earnings for the previous six months.
