This is an appeal from a .judgment of a justice of the peace rendered upon a verdict of a jury in a special proceeding, viz. in summary proceeding for the recovery of the possession of real estate instituted by the petitioner, who is the respondent on this-appeal, under chapter 17 of title 2 of "the Code of Civil Procedure.'
