MEMORANDUM AND ORDER

MORAN, Chief Judge.

Plaintiff Francis Golbeck, a Chicago police captain, challenges the constitutionality of his three-day suspension under the due process and equal protection clauses of the Fourteenth Amendment, and Article 1, Section 2 of the Illinois constitution. Defendants now move to dismiss plaintiff’s complaint, pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure. For the following reasons, defendants’ motion is granted in part and denied in part.
