This action was brought by the plaintiff to recover damages, alleged to have been caused by the defendant's negligence.

On the night of 27 August, 1902, the plaintiff, his wife, Thomas Carson and two other persons, went to the defendant's depot at Gastonia with the plaintiff's sister, Mrs. York, and her six children, the oldest of whom was fifteen years of age (93) and the youngest four years of age, for the purpose of assisting them in boarding the train, which they intended to take that night for a distant point.
