Affirming.
Pike Cross has been convicted of the crime of willfnl murder, and his punishment fixed at confinement in the state penitentiary for life.
Appellant shot and killed George Dilber in the town of Cumberland in Harlan county on the night of January 6, 1937. Appellant and the deceased and several other men had been engaged in a poker game in a room adjoining the saloon owned and operated by John Botnick.
