In his petition, filed in the Circuit Court of the City of St. Louis, he asked for judgment against the defendant in the sum of $5,000 actual damages and $10,000 punitive damages for personal injuries alleged to have been sustained as a result of an assault committed on him by the defendant Nowotny.
