delivered the opinion of the court:

Defendant herein was charged with theft of a motor vehicle of a value exceeding $150. Upon being duly admonished by the court, he entered a plea of guilty and was granted probation for a period of three years on October 28, 1971. Two months later, on December 27, 1971, a petition to vacate probation was filed alleging that the defendant committed an offense of burglary on the 15th of December, 1971.
