This is an action against the defendant as a common carrier. Trial by jury was had. A verdict was returned for the plaintiffs, and judgment thereon was rendered. The defendant excepted.
The declaration is in two counts. The first count is in case, and the second in trover. The cause, as stated in the bill of exceptions, was tried and submitted to the jury upon the first count. The defendant challenges this statement, but in doing so, seems to rely upon language in the charge which, in its connection, is not inconsistent with the statement of the bill of exceptions.
