This is an action by a large number of resident property owners in the Hollis and Bellaire sections of Queens County to recover damages resulting from the flooding of their land and dwellings due to the overflowing of the sewers in that area.

The complaint specifically alleges two separate causes of action (1) that the defendant constructed a storm sewer of insufficient capacity and thereafter negligently maintained it and (2) the defendant negligently granted building permits for new construction in the area and negligently permitted these new owners to connect into the already overburdened…
