ATWELL, District Judge.

In 1913 the Texas Legislature passed the Employers’ Liability and Insurance Acts. In 1917 these acts were amended. Article 5246, Vernon’s Texas Civil Statutes 1918. Article 5246 — 44 (5246) reads as follows:

“All questions arising under this act, -if not settled by agreement of the parties interested therein and within the terms and provisions of this act, shall, except as otherwise provided, be determined by the board.
