DE VANE, Chief Judge.
This is a suit to recover damages for permanent injuries, medical expenses, pain and suffering and other damages sustained by plaintiff by reason of defendant’s negligent parking of a motor vehicle upon a highway in Santa Rosa County, Florida in the nighttime. •In alternate pleas defendant defends on the ground that the negligence of plaintiff was the sole proximate cause of his injuries and upon the ground that plaintiff’s contributory negligence bars his recovery.
