Plaintiff, Club Italia Soccer & Sports Organization, Inc., appeals a September 6, 2005 order granting summary judgment in favor of Defendant, Charter Township of Shelby, to dismiss Plaintiffs due process and equal protection claims. Plaintiff alleges that Defendant violated the Due Process and Equal Protection Clauses of the Fourteenth Amendment as made actionable under 42 U.S.C. § 1983 by accepting a soccer complex development proposal from Soccer City, Inc.
