This was an indictment, in the Criminal Court of Cook county, for keeping “a common gaminghouse” in the city of Chicago. The defendant was tried and found guilty, and the court, after overruling a motion for a new trial, rendered judgment upon the verdict for $200, fine and the costs, to reverse which defendant sued out this writ of error.

The court below sustained a demurrer to a plea of former conviction filed by the defendant, and the sustaining of that demurrer is assigned for error.
