On September 7, 1957, Ready-Mix Concrete & Concrete Prodncts Company, Inc., hereinafter referred to as plaintiff, filed its declaration in the Circuit Court of Warren County against J. R. Perry, hereinafter referred to as defendant. An amendment to the declaration was filed on October 24, 1957.

The declaration was in three counts. The first count sought a recovery of damages for alleged monopolistic practices engaged in by the defendant in violation of Sections 1088 and 1089 of the Mississippi Code of 1942. The second and third counts of the declaration sought a recovery for the alleged…
