Reversing.
The appellant, Frank Anderson, was indicted by the grand jury of Floyd county, charged with murdering Greorge Horn, a policeman in Prestonsburg, and which occurred on May 4, 1929, near 8:30 o ’clock p. m. At his trial under that indictment, he was convicted of voluntary manslaughter, and sentenced to confinement in the penitentiary for a term of 21 years, and, from the judgment overruling his motion for a new trial, he prosecutes this appeal.
