Thompson, Jr., J.), entered February 8, 2007, which, in an action for wrongful death, upon reargument, insofar as appealed from, denied the city defendants’ motion for summary judgment dismissing the complaint as against them, unanimously reversed, on the law, without costs, the motion granted and the complaint dismissed as against the municipal defendants.
