MEMORANDUM RULING

STAGG, District Judge.

This action comes before the Court on plaintiff’s motion for summary judgment. The parties have submitted a joint stipulation of facts in order to obviate the need for trial.

Plaintiff American Telephone & Telegraph Co. (AT&T) is incorporated in New York, which is also its principal place of business. AT&T maintains an underground telecommunication cable on a conventional right-of-way across private lands in Madison Parish, Louisiana.
