This case is of a novel character. The parties were physicians and surgeons, the plaintiff claiming to have been injured by a fraud practiced upon him in the *28making of a contract. In September, 1857, the plaintiff was, and had been for three years previously, practicing medicine and surgery in Milwaukee, in the State of Wisconsin. For reasons of a family nature, he desired to remove to Lockport, in this State, provided his business relations would warrant it. The defendant was- a practicing physician and surgeon at Lockport, and knew of this desire of the plaintiff to change his location.…
