The only question presented on this appeal is whether or not the court erred in sustaining the defendant's exceptions to plaintiff's petition and dismissing his suit after he had declined to amend, and from which rulings plaintiff has prosecuted this appeal.

The substance of the main facts alleged in plaintiff's petition may be stated as follows: From January 1, 1915, to February 15, 1919, plaintiff and defendant were engaged as partners in the general oil business and in drilling oil and gas wells under contract for others.
